Acceptable Use Policy

1. About This Policy

This Acceptable Use Policy ("AUP") explains what you may and may not do when using the TerzyApp platform — the website, the mobile applications, the in-app chat, the review system, the media gallery, and any related service (the "Platform"). The AUP applies to every account holder, whether you are a Customer, a Tailor, a Fabric Manager, or a TerzyApp staff member. It is incorporated by reference into the Terms of Service, the Tailor Agreement, the Fabric Manager Agreement, and every other contract you have with us. This AUP is written and executed in English; translations are for information only and the English version prevails as the sole authoritative version for legal, regulatory, and judicial purposes.

2. Compliance With Law

You must comply with all laws applicable to your use of the Platform, including the Online Safety Act 2023 in the United Kingdom, the Digital Services Act and Member State implementing law in the European Union, U.S. federal and state law where applicable, and the law of any other country from which you access the Platform. You must not use the Platform to commit, facilitate, or encourage a crime, and you must comply with sanctions, export-control, anti-money-laundering, and consumer-protection law.

3. Prohibited Illegal Content

You must not upload, share, display, link to, or otherwise make available content of the following kinds, all of which constitute priority illegal content under the Online Safety Act 2023 Codes of Practice as published by Ofcom, illegal content under the Digital Services Act, and equivalent law in other jurisdictions:

  • Child sexual exploitation or abuse material, in any form.
  • Terrorism-related content, including incitement, glorification, or financing.
  • Content that incites, threatens, or promotes serious violence against a person or a group.
  • Hate speech targeting a protected characteristic (race, ethnicity, nationality, religion, sex, sexual orientation, gender identity, disability, age).
  • Harassment, stalking, doxxing, or coordinated abuse of an individual.
  • Non-consensual intimate imagery, deepfakes designed to harass, or extortion using such imagery.
  • Content that encourages or assists suicide or serious self-harm.
  • Fraud, including phishing, payment fraud, advance-fee fraud, and impersonation of officials, brands, or other users.
  • Counterfeit goods, replicas passed off as branded items, or items that infringe intellectual-property rights.
  • Illegal drugs, regulated substances, weapons, or items prohibited for sale in the destination market.
  • Content that breaches data-protection law, including unlawfully obtained personal data.

4. Prohibited Conduct

You must not, in addition to the content rules above:

  • Use the Platform to harvest, scrape, or extract data about other users, listings, prices, or any other content without our written permission.
  • Use automated means (bots, scripts, headless browsers) to interact with the Platform other than as expressly permitted, including via the official API where one is offered.
  • Reverse-engineer, decompile, frame, or mirror any part of the Platform.
  • Send spam or unsolicited bulk communications through chat, reviews, or any other Platform feature.
  • Submit fake reviews, coerce reviews, incentivise reviews without disclosure, or vote-manipulate the review system.
  • Impersonate another person, a Seller, a Tailor brand, a Fabric Manager brand, TerzyApp staff, a public figure, or a regulatory authority.
  • Circumvent the Platform by inviting a counterparty to transact off-platform for the same or a substantially similar Order during the first 12 months after first contact through the Platform.
  • Use the chat or media gallery to harass, threaten, or defraud another user.
  • Create or use multiple accounts to evade suspension, accumulate fraudulent reviews, manipulate strikes, or circumvent rate limits.
  • Probe, scan, or test the vulnerability of the Platform or any system we operate, except under a coordinated disclosure programme we have published.
  • Interfere with the security of any user account, including by attempting to guess passwords, intercept session tokens, or escalate privileges.

5. Seller-Specific Prohibitions

In addition to the rules above, Sellers (Tailors and Fabric Managers) must not (a) list counterfeit, replica, or brand-infringing goods; (b) mislabel fibre composition, origin, or certifications in breach of EU Regulation 1007/2011 or equivalent law; (c) make false safety claims about a product; (d) operate undisclosed paid placement or shill bidding; (e) submit reviews of their own listings; (f) coerce Customers into withdrawing complaints; (g) ship a different item from the one ordered, except where the Customer has expressly agreed in chat.

6. Body Measurement & Try-On Misuse

You must not use the body-measurement service or virtual try-on to (a) capture, save, or share images of another person without their consent; (b) generate non-consensual intimate imagery; (c) target minors; or (d) train external models. You must not attempt to extract, copy, or reverse-engineer the measurement or try-on technology, or use these services other than in the normal way.

7. Reporting Illegal or Harmful Content

If you encounter content on the Platform that breaches this AUP, applicable law, or any other concern, you may report it through (a) the in-app "Report" tool on the listing, message, review, or media item; (b) email to [email protected] (illegal content notices) or to [email protected] (intellectual-property notices, processed under our Intellectual Property & Counterfeit Policy); (c) the EU Digital Services Act submission process described in our EU Addendum, which accepts notices in any official EU language; (d) the U.S. DMCA submission process described in our US Addendum. We will acknowledge receipt without undue delay, review the report diligently, and inform you of our decision.

8. Enforcement

Where we determine that content or conduct breaches this AUP, we may, depending on severity, (a) remove the content; (b) demote it in rankings; (c) suspend or terminate the relevant account; (d) refer the matter to law enforcement, regulators, or rights-holders; (e) freeze related payouts; (f) require remediation steps before reinstatement. Decisions are accompanied by a Statement of Reasons identifying the factual basis, the legal or contractual basis, whether automated means were used, and the available redress (internal complaint-handling, out-of-court dispute settlement, judicial).

9. Repeat Offender Policy

We operate a repeat-offender policy. Accounts that repeatedly breach this AUP, or that commit a single egregious breach (including listing counterfeit goods, posting illegal content under Section 3, or major fraud), may be permanently terminated. We also reserve the right to decline further business with the same person or business, and to close any new account we identify as belonging to them. Sellers who are permanently terminated under this Section forfeit any future placement and are subject to the post-termination reserve and confidentiality obligations in their respective agreements.

10. Trusted-Flagger Reports

We accept reports from organisations certified by a Digital Services Coordinator as trusted flaggers under DSA Article 22, and we review them under the notice-and-action procedure described in Section 7. Trusted-flagger status does not exempt the flagger from the obligation to submit accurate, substantiated notices.

11. Cooperation With Authorities

Where required by valid order, warrant, or law, we cooperate with law-enforcement agencies, courts, regulators, and trade-mark or copyright rights-holders. Where law permits, we will notify the affected user before disclosure. Where the matter concerns priority illegal content under the Online Safety Act 2023 or another mandatory disclosure obligation, notification may be delayed or withheld as the law requires.

12. Your Sole Responsibility for User Content

You are solely responsible for any content you submit, post, or display on the Platform ("User Content"), including but not limited to reviews and ratings, photographs uploaded for virtual try-on or your Profile, custom-design instructions or sketches sent to a Seller, chat messages, body-measurement values you enter manually, and any other text, image, audio, or data you upload. You represent and warrant that: (a) you own or have all necessary licences, rights, consents, and permissions for your User Content; (b) the User Content does not infringe any third party's intellectual-property, privacy, publicity, or other right; (c) the User Content complies with this Acceptable Use Policy and with applicable law; and (d) the User Content is not false, defamatory, misleading, deceptive, harassing, threatening, obscene, or otherwise unlawful. TerzyApp does not generally review User Content before it is published. We rely on a combination of automated tools, human review, and our notice-and-action procedure (Section 7). Where User Content causes loss to a third party or to TerzyApp, you indemnify us on the terms in Section 18 of the Terms of Service. We may remove User Content at any time, without prior notice, where it violates this Policy, applicable law, or a third-party right notified to us. Removal does not make us the publisher of any User Content we do not remove — we host User Content as an online intermediary under the EU Digital Services Act (Regulation (EU) 2022/2065) and the UK Online Safety Act 2023 and we are not liable for User Content of which we have no actual knowledge of unlawfulness. **How we moderate**: some content may be checked by automated tools when it is submitted, and any content may be reviewed by our moderators, for example after a report. Automated tools are not perfect: they can miss content that breaches this Policy and can flag content in error. You retain sole responsibility for User Content even where our screening did not catch a violation, and we may act on User Content at any time after publication. User Content is recorded against the account that submitted it, together with the content itself and the times it was submitted or changed, so that we can attribute it to an account in the event of a notice, dispute, or law-enforcement request. We also keep technical records of account activity for security, as described in our Privacy Policy. This information is retained per Privacy Policy §10.

13. Platform-Mechanics Abuse

TerzyApp's marketplace mechanics — ratings, reviews, search ranking, recommendations, promotional credits, and trust signals — exist to help honest Customers and Sellers find each other. The clauses below forbid manipulation of these mechanics in ways that would degrade trust for everyone. This Section does NOT restrict genuine consumer feedback or honest seller responses to criticism; only inauthentic, coordinated, or commercially-incentivised manipulation is forbidden. You will NOT:

  • Post a review of an Order, Seller, or product you did not genuinely transact with or experience (fake review).
  • Exchange reviews with another user (review swap) — "I review yours, you review mine".
  • Pay, offer to pay, accept payment, or accept any other inducement in exchange for posting, removing, editing, or voting on a review (paid review). This restriction tracks EU Omnibus Directive (Directive (EU) 2019/2161) Art 7(6) and US FTC 16 CFR Part 465.
  • Operate multiple accounts to inflate the visibility of your own listings, suppress competitors, or evade a previous suspension (sockpuppet / multi-account abuse).
  • Use bots, scripts, or coordinated human campaigns to brigade ratings, upvote / downvote reviews, or flood reporting tools to suppress legitimate content.
  • Game the recommendation or search-ranking algorithms by keyword-stuffing listings, mass-tagging unrelated categories, or any other inauthentic listing optimisation that would degrade Customer search quality.
  • Abuse promotional credits, referral programmes, or first-order discounts by creating accounts for the sole purpose of claiming the benefit.
  • Post screenshots, exported chat transcripts, or order records of other users on social media or other public forums in a manner that identifies them and is intended to humiliate, harass, or retaliate (doxing / shaming). Genuine warning posts about scam Sellers, posted in good faith to public consumer-protection forums, are not restricted; targeted harassment is.

14. Changes to This Policy

We may update this AUP from time to time. Material changes are notified at least 30 days in advance by email or in-app message. Non-material changes (clarifications, corrections, new examples) take effect when published. The "Last updated" date reflects the current version.
